The father of a toddler who died after being swept away by floodwaters during a rainstorm in Barstow last month appeared before a judge on Tuesday following his arrest.

Brandon Aguilera Padilla, 26, was arrested on suspicion of murder on Friday in connection with the death of 2-year-old Xavier Aguilera. The young boy’s body was found following an exhaustive search after he and his father were separated by floodwater.

After a brief court appearance Tuesday, Padilla’s charges were reduced to vehicular manslaughter and child abuse, both of which he pleaded not guilty to.

Detectives said the father and son were inside the family’s vehicle when it was swept away by a surge of water on Sept. 18. Police said that at some point, the two were separated by the water.

Padilla was found on an island that was created by the water and was rescued. The toddler was found after a 20-hour search and did not survive.

According to the family, the tragedy was an accident.

Police would not say what evidence they’ve gathered to accuse Padilla of the charges. His bail has been set at $200,000.
